Use of Enforcement Power to Fine Institutions and Servicers Participating in Title IV Programs

On January 15, 2019, NSLDN submitted a FOIA request to the United States Department of Education seeking all documents constituting notice to either institutions of higher education or third-party servicers of its intent to begin fine proceedings by the Secretary, pursuant to her authority under the Higher Education Act (“HEA”). The Secretary’s authority to begin fines proceedings is intended to assist enforcing institutions and servicers to operate in accordance with all statutory provisions applicable to Title IV of the HEA.
