Use of Enforcement Power to Limit Institutions and Servicers Participating in Title IV Programs

On December 19, 2018, NSLDN submitted a FOIA request to the United States Department of Education seeking all documents constituting notice to either higher education institutions or third-party servicers of its intent to limit it participating in Title IV programs by the Secretary, pursuant to her authority under the Higher Education Act (“HEA”). The Secretary’s use of this limitation power is meant to assist enforcing institutions and servicers to operate in accordance with all statutory provisions applicable to Title IV of the HEA.
